The comprehensive legal guide to buying a property in Morocco (step by step)
Buying a property is one of the most important financial decisions you will make in your life. To ensure that this process goes smoothly and completely safely in Morocco, it is very necessary to understand the legal and administrative steps accompanying it. Avoid rushing, and be sure to follow these basic steps to protect your investment:
1. Verifying the legal status of the property (ownership certificate)
Before paying any dirham or signing any paper, you must go to the National Real Estate Conservation Agency (or request it online) to obtain a recent “certificate of ownership”. This document confirms to you that the seller is the real owner, and that the property is not burdened by any debts, liens, or bank mortgages.
2. Signing the “Promise to Sell” (Compromis de Vente)
It is a preliminary agreement usually concluded with a notary. At this stage, the final price, property delivery date, and performance method are determined. The buyer pays a financial deposit (often between 10% and 20% of the property value) which is placed in the notary’s account as a deposit to ensure the seriousness of both parties.
3. The role of the notary (the main focus of the process)
In Morocco, using a notary is mandatory in real estate transactions to ensure transparency. The notary is responsible for collecting documents, verifying that the seller is exempt from taxes (such as housing and communal services tax), and drafting the final contract in a way that preserves the rights of both the buyer and the seller.
4. Signing the final sales contract
After the notary prepares all the papers, and the buyer provides the remaining amount (either in cash or via a bank loan), the final contract is signed. At this moment, the money is transferred to the seller, and the buyer receives the keys to his new property.
5. Recording and memorization (final stage)
The process does not end with handing over the keys. The notary is responsible for registering the contract with the Tax Administration, then depositing it with the Real Estate Governorate to officially transfer ownership to your name. This step is what gives you full legal status as the owner of the property.
